NLRA New Posting Requirement
NLRA New Posting Requirement
Under a new rule passed by the National Labor Relations Board, employers covered by the National Labor Relations Act will be required to post a notice that advises employees of their right to organize under the Act. The Board made the new rule out of the belief that many employees are unaware of their rights under the NLRA. The rule applies to both union and non-union employers, and failure to comply can be the basis for an unfair labor practice charge. Failure to comply may also, in the Board’s discretion, result in a tolling of the six-month statute of limitations for filing an unfair labor practice charge.
The rule goes into effect on November 14, 2011. The Board’s press release regarding the rule is available here, and the final rule is available in the Federal Register
